Inclusionary Housing
According to the San Diego Union Tribune, over 1,000 people attended the hearing which lasted from 10:00 am to 6:30 pm. About three-quarters of the attendees were in favor all of the items on the Agenda, the balance were opposed to inclusionary.
The Council passed the following items:
- Inclusionary Housing - directed the staff to prepare the necessary ordinances for a citywide requirement that 10% of all new residential units must be affordable to those at an average of 65% of AMI for rental units and 100% of AMI for for-sale units. The measure must also include developer incentives for affordable units. There is an in lieu fee available as well. Click here for the details. This passed 9-2. Mayor Murphy and Council Member Madaffer voted against this item.
- The official motion was:
Motion by Inzunza to adopt and accept the Land Use and Housing proposal in its entirety with the following additions:
- Direct the legislative affairs office to actively participate in discussing and seeking construction defect litigation.
- Provide mandatory processing deadlines for the entire project if the developer agrees to build inclusionary units.
- At the time the application is deemed complete, have in-lieu fees specified.
- The inclusionary housing policy shall go into effect when the city council adopts the findings of the task force and sets forth a schedule for implementation, all which is not to exceed six months from the creation of the task force. the preparation of the comprehensive housing policy shall not delay implementation of an inclusionary housing policy, rather complement the effort and shall be developed in a parallel manner.
- If a developer is willing to develop properties or develop a piece of land that would target 150 percent medium (sic) income, with two or more units with a minimum of two bedrooms, the inclusionary housing proposal for those sites would be waived. this will help families of four with an income of between $65,000 and $85,000.
- As directed by Council Member Wear, refer the issue of making sure that housing is constructed which meets the Americans With Disabilities Act to LU&H committee.
- Direct the city manager to evaluate energy efficient developments.
- Continue to work on a process in which large projects are not over burdened which may cause those large projects not to be built and in turn would cause the depletion of funds.
- Ensure that the redevelopment agency can waive the requirements and staff shall determine what those guidelines will be and report back to council.
- As requested by Council Member Peters, direct the city manager to focus more on transit and less on parking. work towards providing a transit system that people can rely on thereby making housing more attainable for everyone.

The original proposal from the San Diego Housing Commission to adopt an Inclusionary Housing Ordinance for the entire City of San Diego (the North City Future Urbanizing Area already has an inclusionary requirement) is based on the recommendations made by the Land Use and Housing Committee on April 17, 2002.

The Proposal received unanimous support from the San Diego Planning Commission on August 1, 2002. The Planning Commission recommended increasing the requirement for off-site construction to 15% and eliminating the In Lieu Fee option for all projects except the very small. Updated August 26, 2002
